Avoiding Probate in Florida
In some instances, probate can be avoided by making sure an estate plan clearly designates who the beneficiaries are and the intentions of the deceased. Other types of documents can also be drafted to allow for certain assets to pass to others outside of the probate process.
Miami Small Estates Attorney
For small estates, an informal probate process is generally approved by the courts. This requires very little reporting and appearances in probate court. Our office routinely helps people with small estates with estate will settlements and executor duties.
Representation in Formal Probate Proceedings
Miami probate process attorney Randy A. Bryant has been providing probate and probate litigation services since 1998. He is also skilled at helping larger estates through the formal probate process required by the courts.
The more formal procedures for larger estates do require more reporting to the court, including a detailed inventory of all the assets being distributed and reports of the order in which creditors are paid. There may be multiple appearances before the judge assigned in probate court, and any matters of dispute may be argued before them. If a dispute does arise and probate litigation becomes necessary, we are fully prepared to handle your case and go to trial.
