The Resident Bill of Rights carefully lists all of the rights of those in nursing homes and mandates zero tolerance for nursing home violations. The listed rights include:

  • The right to be free from physical or mental abuse
  • The right to receive adequate and appropriate health care and support
  • The right to be informed of one’s medical condition
  • The right to freedom of choice in selecting a personal physician
  • The right to civil and religious liberties
  • The right to participate in the planning of all medical treatment

Additionally, Florida law requires that each nursing home be equipped with sufficient staff and qualified health care providers.

If a nursing home fails to meet these requirements or fails to act with reasonable care in providing for a nursing home resident, including violating the Resident Bill of Rights, the nursing home and/or its staff may be liable for negligence.
